Data protection and security

Optimum Management Financial Services SA is committed to respecting the privacy of its Customers – policyholders – affiliates – members – employees – etc. (hereinafter “Customers”).

 

The purpose of this general privacy policy is to describe how Optimum MFS SA collects or stores the personal data (hereinafter "data"), of its Customers, how it is used and to whom this data may be disclosed.

 

Data processing by Optimum MFS SA is subject to the applicable data protection laws in force in Switzerland, in particular the new Federal Data Protection Act (hereinafter “nDSG” ) .

 

Optimum MFS SA undertakes to:

  • use the Data only for indicated purposes ;
  • only collect the Data that is necessary for those purposes ;
  • not keep the Data for longer than necessary for those purposes ;
  • disclose the Data only to authorized organizations or persons who need it in the course of Optimum MFS SA 's business ;
  • inform its Customers in a clear and transparent manner about Optimum MFS SA’s use of the Data and on the Customers' rights.

  • To be able to establish offers / contracts / comparisons and other administrative requirements.

  • First Name Last Name of Customer
  • Date of birth
  • Gender
  • Legal status
  • Nationalities
  • Phone number
  • Email and postal address

 

  1. DATA PROTECTION RIGHTS

In application of the nLPD , Customers have in particular the following rights:

 

Right of access – the Customer has at any time and without giving reasons, the right to ask Optimum MFS SA for a copy of his Data.

Right to information – the Customer has the right to be informed about how their Data is used. This policy and any additional information is intended to provide this information.

Right to withdraw consent – If the Data is processed on the basis of consent, this can be withdrawn at any time.

Right of rectification – the Customer has the right to request Optimum MFS SA to rectify inaccurate Data and to complete incomplete Data.

Right to restriction of processing – the Customer may request restriction of the processing of Data, where permitted by law.

Right to erasure/removal – the Customer has the right to request Optimum MFS SA to erase or remove Data. Unless a legal basis or the legitimate interest of Optimum MFS SA requires or authorizes to retain the Data.

Right to object to processing – the Customer has the right to object to the processing of their Data at any time.

Right to delivery or transfer of Data – the has the right to ask for data to be deliveredr or transferred in a portable format if the processing of the data is carried out automatically on the basis of consent or a contract.

Right to file a complaint - if the Customer is not satisfied with the way in which the Data is processed, he or she can turn to a court or to the federal data protection authority.

 

The exercise of these rights is free of charge. All enquiries relating to the processing of Data should be sent to the following address: rh@optimum.swiss .

 

  1. DATA COMMUNICATION

Optimum MFS SA may disclose the Data to its employees, partners, subcontractors, consultants and suppliers only in order to fulfil its duties and provide its services, as long as legal conditions are met.

 

To protect the privacy and security of its Customers, Optimum MFS SA may take reasonable steps to verify their identity before granting access or making corrections.

 

  1. TRANSFER ABROAD

Customer Data is only processed in Switzerland and is not transferred abroad.

 

  1. MARKETING

As Customers of Optimum MFS SA, marketing communications (e.g. newsletters) from Optimum MFS SA relating to its business may be sent if the Customer has opted in to receive these communications.

 

Marketing communications from Optimum MFS SA will always include the option for the Customer to unsubscribe from receiving any other marketing communications.

 

The Customer may unsubscribe at any time by sending an email to conseils@optimum.swiss and requesting that their name be removed from Optimum MFS SA marketing lists.

 

  1. COOKIES

Optimum MFS SA uses cookies and other technologies on its website to enable the collection of certain information from the Customer's browser. Cookies are commonly used on the Internet.

 

Cookies are small text files that are placed on the Customer's computer by the websites visited. They are used to make websites more functional or efficient, as well as to provide information to website owners.

 

Optimum MFS SA may collect information about the Customers computer for system administration purposes, including, where applicable, the Customer's IP address, operating system and browser type. This is statistical data about Optimum MFS SA's browsing actions and navigation patterns and does not identify any individual.

 

Cookies help Optimum MFS SA to improve its services and provide better quality and more personalized support. They also help Optimum MFS SA to ensure that the Customer has read all relevant legal information and to analyze how the Optimum MFS SA website is used.

 

  1. SECURITY

Optimum MFS SA undertakes to ensure the permanent security of the Data. Customers data is protected against any unauthorized processing, in particular against the risks of forgery, destruction, theft, loss, copying and other unauthorised processing, by organisational and technical measures that comply with Swiss norms, quality standards and technical progress.

 

Optimum MFS SA takes reasonable and appropriate measures to maintain the confidentiality and integrity of the Data and prevent unauthorised use or disclosure of the Data in accordance with the nLPD.

 

This data, including its backups and data related to Customer support activities, is hosted by one of our subcontractors in Switzerland.

 

Optimum MFS SA only processes Data only in a manner compatible with the purpose for which it was collected.

 

To the extent necessary for these purposes, Optimum MFS SA takes reasonable steps to ensure that the Data is accurate, complete, current and otherwise reliable in relation to its intended use.

 

  1. HOW LONG DOES Optimum MFS SA RETAIN DATA?

Optimum MFS SA will retain the Data only for as long as it is necessary to achieve the purposes for which it was collected, to meet the needs of Customers and to comply with Optimum MFS SA’s legal obligations.

 

Optimum MFS SA applies the following criteria to determine the Data retention period:

 

  • Optimum MFS SA retains data for the duration of the services or service contract;
  • If the Customer has agreed to receive marketing messages (e.g. newsletters), Optimum MFS SA will retain the data until the Customer unsubscribes;
  • If cookies are placed on the Customer's computer, Optimum MFS SA will only retain the data for as long as is necessary to achieve the purpose for which it was collected (e.g. for one session for cookies associated with registration or for session identification cookies).

 

Optimum MFS SA may retain the Data to fulfil its legal or regulatory obligations and to enable it to exercise its rights (for example to bring an action before any court) or for statistical or historical purposes.

 

When Optimum MFS SA no longer needs to use or retain the Data, it deletes it from its systems and files or anonymises it so that it can no longer identify Customers.

 

  1. CHANGES TO THIS POLICY

Optimum MFS SA reserves the right to modify this policy at any time.

 

Any modification of this policy will come into force when Optimum MFS SA informs Customers.
